What do i do if the person i bought the phone from is not the original owner and doesnt have the iCloud info?

I bought an iPhone 5 off eBay, and it was iCloud locked, the person who i bought the phone off of was not the original owner (no it wasnt stolen i IMEI checked it) and does not have the icloud info. what do i do?

Contact eBay about their return policy. The phone is worthless to you.
