Apple describes in Turn off Find My on your iPhone, iPad, or iPod touch that "Find My also includes Activation Lock, a feature that's designed to prevent anyone else from using your iPhone".

As described in Apple's support document How to remove Activation Lock you need the original owner to sign out of iCloud.

If you cannot do that you cannot use the iPhone.
