Complaints to Apple store

I visited the apple store at the Potomac town center, VA for battery replacement, but they said there is a problem with the home button, so they gave me a new phone without my permission and they did not give my old phone. I thought they transferred my data from the old phone to the new phone. When I got home and turned on the phone, it was clear. My data weren't transferred to the new phone. They didn't transferred my data. So I visited the Apple store again to get my old phone and restore my all data. They said they don't have my old phone and my data have been gone already. They did not even ask my permission to delete my data and replace to a new phone. I am very disappointed. I have told them that I don't use iCloud and iTunes before getting a battery replacement. How can I get my data back?
