Data erased after 6 passcode fail attempts

I know datas will be erase after 10 fail attempts when you have that option turn on but I'm pretty sure I had it off because it happened once before and it was only the 6 attempt when it erased everything. why is this happening?

p.s. I think it's 6 attempts because it was erased right after the screen says iPhone disabled 5 minutes
