I understand your frustration. I’m not sure what is or is not working such as controlling ATV with the remote, or the volume on the TV. It may be best to contact Apple Support after trying the following.
Recommend charging the Siri remote (please confirm the charging cable charges another iDevice), installing and setting up iDevice remote app (which it sounds like you already did), unpairing Siri remote, power cycle ATV (unplug for a minute), pair Siri remote.
Recommend verifying the IR ports are not obstructed on the ATV remove and TV as this is how they communicate for volume control.
Recommend verifying the HDMI has good connections at both ends by checking to see that the connectors are clean and fully and securely inserted or seated in the ATV and TV. Trying a different HDMI port in the TV or another cable may fix the problem.

I’m looking forward to a post that you are successfully up and running.

Ok. I have posted a support article below. You may have gone through most things, but just take a look in case there is anything. Beyond that, I would advise to contact Apple support
How long did you charge it for? Did you try a different cable?
