what if you did not do a back up

if my old iphone is broken and never had the back up done is there no way to get my information to transfer over to a another phone

Basically no as the others have already mentioned. The only possibility of accessing some of your data would be via iCloud, and that would be for services that have been syncing to your iCloud account ... like Contacts, Notes, iCloud mail, etc.
