You take the device, its purchase receipt, and the owner's death certificate to a physical Apple Store or otherwise contact Apple. You will need written proof of purchase and ownership at time of death of the deceased and a certified copy of the death certificate and proof that you are the beneficiary.

Information was helpful but "helpful friends" wiped it before she was able to get to the valued pictures. Your right about security and in this new world, computer and phone info are valued information and need special consideration as to how our loved ones can gain access in the case of death or incapacitation. Thanks anyway, lesson learned the hard way.
