You can't,only they can remove the activation lock so that you can use it.

About Activation Lock on your Apple Watch - Apple Support

They need to follow all the steps in this link;

What to do before you sell, give away or trade in your Apple Watch, or buy one from someone else – Apple Support

If they can't or won't,get your money back because the watch will be of no use to you.
