My ipod touch is in activation lock and I can't access anything on it to correct the problem
How do I unlock the ipod when I can't remember the Apple id or password

Use Apple's iForgot service, or contact their Account Security team, or if you're the iPhone's original owner, supply Apple with its purchase receipt and ask them to remove the lock.
For reference, a second generation iPod touch cannot be activation-locked because of the iOS version requirement.
