Used Apple Watch. Previous owner has not removed from Apple Account.

I got my Apple Watch used and I can’t get the first owner to remove the watch from their apple account. It has been several weeks. Can I use my Apple Watch without them removing the device or how can I proceed?

The person that you bought this watch from needs to follow all the steps in this link;

Prepare the watch so the buyer can use it.

If they can't or won't then get your money back or recycle the watch and put it down to experience.
