I can't unluck my iphone

I bought a new phone but the old icloud is still logged in there and i can't log it out

So you bought a used iPhone and the original owner did not sign out of their iCloud account... right?

Return it and get a refund. Only the owner of the account used to lock it can remove the activation lock. You can't bypass it.
