Yes, but only if they were the owners of the phone and know the PW. This is unlikely. I would try contacting them but don't get your hopes up, if they were the owners they would have sold it to you unlocked.

No, you will never be able to use the phone. You can recycle it at any Apple Store. Next time buy from Apple or authorized dealer. Apple has refurbished Macs on their web site at reduced prices.
