What about if I bought it secondhand and the seller refuses to take it off their iCloud account

Activation lock So I got this Apple Watch series three from eBay and the seller has 5 stars and no bad reviews I read the description and it says unlocked so I by it and it’s linked to someone else’s iCloud, how do I get there iCloud off of it so I can pair it?

How can you take off an activation lock? I just bought this used series 1 apple watch and as I am trying to set it up, the activation lock is still set to the previous owners icloud/apple ID and I asked them about it and they replied saying that they had takin it off of there account. I was wondering if you could take off the activation lock so I could finish setting it up.

Then return it and get your money back,the watch is of no use to you.
