Stolen phone but they know the passcode.

What do you do if you know the person that stole your phone but you can’t prove it! they have the Internet off on it so you can’t do anything like erase it, and I they know your passcode. How can you change your passcode or what are the steps to take.

As long as they don't know your Apple ID password, the phone is protected by the Activation Lock.

And it will be erased when it connects to the data network again, as long as you don't remove it from your device list.
