What is your model Apple TV? Identify your Apple TV model - Apple Support
Are the Apple TV and your phone already on the same home network? If not, then you may need a physical remote anyway before you can use the software remote.
From Apple or other retailers (Amazon, Best Buy, eBay, etc.).
For Apple TV (3rd generation or earlier), get the Apple Remote (aluminum).
For Apple TV (4th generation or later), get the Siri Remote.
You can buy them directly from Apple. Once you identify the Apple TV you own, then you will be able to determine which remote you need. You can also find them on Amazon too. Once you get the remote you will need to pair it with your Apple TV. Once you let us know which Apple TV you have we can get you the instructions on how to pair a remote with the Apple TV.
It sounds like you may have either bought it used or inherited it from someone else. If so you may need to unpair any remotes first and then pair the new remote. I see Apple no longer sells that remote (the Apple TV is obsolete now) so I found one on Amazon:
