Unable to delete Data/DataVaults file from Trash on MacOS Big Sur

Anyone know how to do this? Attempting

sudo rm -r ~/.trash/Data/DataVaults

from terminal gives

rm: Data: Operation not permitted

This post seems to suggest a complete reinstallation of MacOS is needed which as the original poster notes is absolutely absurd.

Has anyone (or Apple) figured out a way?

iMac 27″ 5K, macOS 11.5

Disable SIP via recovery mode csrutil and then remove the file in question and then Enable SIP again as soon as done.
