It sounds like you have lost your iPhone and now want to set activation lock on it.

Click on this link for general information about what to do "If your iPhone, iPad, or iPod touch is lost or stolen" --> https://support.apple.com/HT201472

In particular:

Use Lost Mode in Find My iPhone on iCloud.com - https://support.apple.com/guide/icloud/use-lost-mode-mmfc0f0165/icloud

and:

Use the Find My app to locate a missing device or item - https://support.apple.com/HT210515

"What happens if you activate Mark As Lost

Mark as Lost remotely locks your missing iPhone, iPad, iPod touch, or Mac with a passcode, keeping your information secure even if your device goes missing. You can also display a custom message with your phone number on the Lock screen, and keep track of your device's location.

Once Mark as Lost is activated, Apple Pay is disabled, if you have it set up on the device. A confirmation email is sent to the primary email address associated with your Apple ID. When you recover your device, you will need to unlock it with your passcode."

To clear an Activation Lock, you will need the password of the associated Apple ID, or the original purchase receipt and matching photo ID and a discussion with Apple Support.

If this device was recently purchased and the seller is still available, contact the seller for remediation or for refund.

A remote unlock using iCloud is available to the person with the Apple ID holding an Activation Lock, if they’re inclined to unlock this device.

Activation Lock is a theft deterrent mechanism. A theft deterrent that is easy to bypass would not be much of a deterrent.

No, nobody here in the Apple discussion forums can help you clear Activation Lock. Only the person holding the Apple ID associated with the Activation Lock, or Apple, can clear this lock. For Apple to clear the lock, you will have to provide a receipt with proof of original purchase and with matching serial number, and provide matching personal identification, or similar materials.

There is no means for a user to remotely activate Activation Lock.

Mark As Lost can be remotely activated, but Find My and Activation Lock are a prerequisite for that and must be enabled before the loss or theft; before Mark As Lost can be available.

If Activation Lock and Find My are not already enabled, then notifying the carrier of the IMEI and (if it's an option for the user) the police are about the best options.

The original question was ambiguous. You were answering this from the perspective of a user wanting to regain use of a device with activation lock on it. I was reading it as the OP asking how to ensure a lost device had activation lock set on it, and providing by extension general advice as to what to do if a device is lost. The lost mode link describes what should be done in association with Activation Lock: "While Activation Lock works in the background to make it more difficult for someone to use or sell your missing device, Lost Mode clearly shows anyone who finds your device that it still belongs to you and can’t be reactivated without your password."
