Battery Draining:

The battery will eventually drain, bring it down to ultimate failure. So, how old is this? Return it, and get a new one.

No. Returning it can only be performed in the country in which it was purchased. The same goes for AppleCare coverage. So, send it back, and have someone return it for you. Or, sell it with a note of it not fully charing.
