I just got an iPhone 13 pro max, after using an 11, does Facial recognition, gets transferred with the rest of my data ? My husband transferred everything before I got the chance to read about it, so I’m not sure if there are sign in issues because of this and if facial recognition is one of them

No. Face ID would have had to be set up before any data transfer happened.
Your husband probably used his face to set it up and not yours.
Go to Settings->Face ID & Password and remove his face and add your own, or add your face in addition to his.
