Sign into the same Apple ID and turn on iCloud photos.

Restore them where? Are they in iCloud, or on a device?

From iCloud. Was uploaded from old phone and now how do I download to the new phone?

Go to Settings><yourname> and iCloud. From there, you turn the switch on for Photos.
