Forgot passcode

I am afraid the only way to get to those photos is by knowing the passcode. Sorry. The best you or Apple can do its to erase the device so that you can use it.

If you want to Make this your Device:

1. Get Access: to his account
2. Sign Out: of his account on it
3. Sign In: on it with your account

Recovering Lost Photos:

Have you been making periodic backups of this iPhone to either iCloud or a computer running iTunes/Finder? If so, you may be able to recover them from one of those backups. Also, if you have been using iCloud Photos, you should be able to access them from there.
