That situation has nothing to do with not being able to create an Apple ID on your iPhone. That is done on a computer in https://appleid.apple.com and is needed if you have created more than 3 IDs on that iPhone.

Regarding not updating

Check 

• you are on a good Wi-Fi, 
• on charge with more than 50% charged, 
• no VPN installed 
• low power mode turned off. 
• Fully working cellular network connection via your SIM.
• Check Settings, General to make sure you have no Beta profile installed.
