Only the person signed in can sign out of it. Elsewise it is useless to you. So, return it to the seller, or have then sign out of it (if their account).

You are going to have to contact them to remove the Activation Lock. If you cannot contact them, then the device is useless to you. You will not be able to activate it. Recycle it responsibly or turn it over to the local police.
