I had received a iPhone 6s

I want to log out with their apple id

when i do so will it log them out on their i phone 12 pro max also same user id

i want to use my own apple id .?

Ask the previous owner to read this Apple article: What to do before you sell, give away, or trade in your iPhone, iPad, or iPod touch

Then the previous owner can remove the iPhone from his/her account, see this Apple article: Check your Apple ID device list to see where you're signed in

After he/she remove the iPhone you can sign in with your Apple ID.
