can't seem to get my iPad air 3rd gen to update it's os it is A1475 always says it's up to date

That's a first generation iPad Air, not a third. It's not capable of 13 or above; if it reports that a version older than 12.5.5 is up to date, remove the beta profile and restart the unit.
