If you are referring to a scratch in the metal portion of the iPad, that would be considered a cosmetic issue and is not covered under warranty. Apple does not replace devices for cosmetic issues. You could see about an out of warranty replacement, but that is going to cost you out of pocket.

This is up to you, and if you are willing to pay out of pocket if you do not have Apple Care. Scratches and cracks can splinter over time with use(touching and stress), creating a larger problem, and becoming susceptible to dust and water getting into the screen and internal components.

No, you did not mention that was in the screen. That is still considered user damage and will not be covered under warranty. Screens are not covered under the warranty for damage unless it was received like that. But given that you say your warranty expires Feb 15, the device isn't new.
