AirPods 3rd Gen touch controls intermittant

Having issues with the right AirPod where the touch controls don't always work. I don't hear the 'click' and the functions don't work. Left side works fine. I can usually get them to start working if I put them back in the case, sometimes both left and right. Wait 10-15 seconds then try again and usually it fixes it.

These are only a week old. I've verified the firmware is up to date. Iv'e paired and unpaired. Deleted from bluetooth and added back. I've see the issue intermittently on my iPhone, iMac, iPad and MacPro.

Any ideas?

Sorry this did not help. I kinda wonder if this is a software issue based on the behavior. Would be nice if Apple would publish and open defect list on their products.
