Activation lock requesting password

Just received an email from apple for Activation lock requesting password for a iphone I lost about a month ago.

So does the person who found/stole the phone, need to insert a SIM for this email to be sent to my email or is it as soon as it turned on?

The email is sent to your Apple ID email address. It has nothing to do with the phone relaying the email.
