You cannot get access to his phone if it is disabled; it must be reset to factory conditions. After resetting you can restore a computer or iCloud backup to recover its contents. I see other user-volunteers have provided a link on gaining access to his Apple account.

Keep in mind if someone else kept trying to guess the passcode more than 10 times and the phone went into disabled mode all the data on that phone is gone.
