Is the phone new as in purchased by you directly from Apple or an Apple Authorized reseller, or new to you but previously owned? If it is the latter the previous owner did not clear it correctly. This is what they need to do→What to do before selling or giving away your iPhone, iPad, or iPod touch before you can use the phone.
