I don't know if you can help me but, my brother in-law gave me his apple watch and i tried to set it up but a activation lock comes up and i wondered why and than found out that he didn't erase it from his apple id and to make things worse he gave the iphone away. So is there anyway you can help me?

Ask your BIL to follow the steps listed in How to remove Activation Lock.
For your brother in law;
He can ask apple to remove the activation lock online on this page;
Remove the Activation Lock Here.
Or this;
If he can't remember/gain access to the apple id that paired the watch to the phone.Take the watch and it's receipt with the serial number along with some photo id and any other proof of ownership to an Apple Store and request that they remove the Activation Lock for you.
