Try this:

If you can't connect to the App Store, iTunes Store, or other Apple services - Apple Support

During an iPhone restore, 400 isn’t listed, which going through the ”try these steps first” at the top of the Related Article linked above, and through the App Store connection issues above, and if the 400 error persists means contacting Apple.

Also: If there’s a VPN client add-on around anywhere, remove it and restart and try again.

Updating? Try updating directly on the iPod (Settings>General>Software Update)
