Trying to set up apple watch

Hello there,

My original apple watch was lost and I am now using my husband, he has deleted his watch from his cloud and Apple ID and when I try to set it up on my phone it doesn't let me. It says

" If you were given this device or purchased send hand, please contact the owner to have them remove this device from their account."

So now we are stuck! Can anyone help??
