I bought a used iphone 5 at a flea market and was informed it was unlocked but it wS not and i have absolutely no way to contact the prior owner

An activation-locked phone will remain unusable w/o the cooperation of and action by the “locking” owner.

See if you can obtain a refund, otherwise chalk it up to a learning experience.
