What do you mean by "is not working"?

• If the battery drains quickly or if your phone no longer turns on, make an appointment at a Genius Bar to change your battery: Genius Bar Reservation and Apple Support Options - Apple
• If the battery does not charge to the maximum: If your iPhone or iPod touch won't charge - Apple Support

Then it is time to make an appointment at the nearest Apple Store for a Battery Replacement.
