About this Issue:

Seems this hacker made themselves the original owner somehow (perhaps by reformatting it). So, you'd need to have them sign out of it, and disassociate it from their account. You may need to wait 90 days until you can associate it to a different Apple ID.

So, to Get Back...

As you might suspect, no one here has access to this device, of course. So, contact Apple Support. Ask them to run you thorughthe fix.
