my phone didn't back up when it was exchanged with warranty, the tech at the Apple store said it would. I have critical text messages on there that I need for a current ongoing custody modification. How do I get the data off that phone before they erase it?

Troubleshooting an Already Traded-In iPhone
A. Get this Back:
Contact Apple Support, requesting they send it back to you.
B. Prepare this Data Transfer:

C. Check your Carrier’s Site:
Log in to your Carrier’s site, seeing if you can view a history there. Doing so, I can see a call log going back 90 days —but not a text messages log.
You can't remotely. If they still have it at the store, and it powers up and you can log in, you can create a backup. If you can't log in, then you can't backup.
