My new iPhones has not uploaded my photos from my lost iPhones

It seems I have lost my photos on my lost iPhone. I got a new iphone 13 but my old pics have not been uploaded ?

im sure I have backed up my photos

If you restored from backup, it should come back unless you had this enabled which isn't part of the backup Set up and use iCloud Photos - Apple Support
