using a time machine backup for a migration
If I use a time machine backup for a migration to a newer computer with a newer operating system, will the newer operating system be maintained

To add a bit to tjk's response, using Migration Assistant to restore a Time Machine backup to a new device, does not restore the old operating system ... especially now with the latest versions of macOS, where the system files are in a "locked" volume.
