No when I got my new phone they took my old phone. It’s unpaired though because I had to reset it erase everything and start over
Did they/you remove the activation lock?,a watch can only be paired to one phone at a time.

Okay what if my watch isn’t in the find my iPhone. But it’s on my devices in settings. Should I erase it there?
