Advice On Amazon Apple Max Headphones?

Hi bought apple max headphones on amazon when they arrived tried connecting to iphone but looks like they been used but all wrapped up. Amazon agreed to return but just found out that they wont refund me because it has diffrent SN on it. I am lost on what should I do?
