Keeping your device up to date is one most important ways to maintain the security of your iPhone 12 Pro Max. If you haven't already, follow the steps in Update your iPhone or iPad to back up and update your device to the latest version of iOS.

Probably not. What makes you think it might have been? Most symptoms that people think are the result of "hacking" are actually something much less nefarious (though not necessarily cheap to fix). If you describe exactly what you're seeing that is causing you concern, people can give you some advice on what is actually going on and what you might need to do.
