I am running Ventura on Mac Mini and importing from a folder of pictures with nested folders. I have checked the box to maintain the folder organization. If I choose to create a new album, the import fails to maintain folder organization. If I choose "None" for "album" then the import works. Both tests were done with a new empty library and my mac has iCloud photos turned off. This is very repeatable.

It is to be expected, if you select to import into an album. Albums cannot hold subfolders, so the folder organization cannot be saved, if you specify to add the photos to an album. Use always "None" for the album, if you want to preserve the folder structure.

That is indeed a poor design and confusing. You may want to send feedback directly to Apple and let them know. Feedback - Photos - Apple
Thanks for the feedback, I didn't know that albums cannot contain folders. However, I feel that it is very poor interface design on the part of Apple. If you check the box to "maintain folder organization" then it should probably grey out the option to specify an album. You shouldn't be able to enable both options which act counter to each other.
