AirPods Max head detection not working (sensor or firmware issue)

AirPods Max head detection not working. I have to reset my headphones after every use to ensure it works connect it again. I have sent this for repair twice during warranty and some part were replaced and was shipped back. I am 3 month out of warranty now. I have tried every possible solution on the internet and it didn’t help. I am not sure if this is a hardware issue for the sensors. Please provide any solutions to fix if possible ? Is it possible to request for a replacement since it had issues during warranty period.
