apple watch activation locked to user refusing to help

If the seller is unwilling to do what is detailed in this link, you have wasted your money --> What to do before you sell, give away, or trade in your Apple Watch, or buy one from someone else - Apple Support

The seller MUST remove the watch from their account. If they are unwilling or can't do that, the watch is useless to you or anyone else. Apple will NOT help you. We cannot help you. Only the seller, assuming they really are the original owner of the watch can do that.

If you can't get your money back, chalk this up to a bad buying decision and recycle the watch responsibly.

There is no fix if the original owner doesn't remove the activation lock.
