Make sure to scroll to the end of the terms to see if the button becomes active.
Did you sign into your AppleID during setup? If so, then just go back to when it asked you for your AppleID. Don't enable your AppleID, then when you step forward you should be able to acknowledge the Terms. After accepting the Terms & logging in, then you can sign back into your AppleID.
If you are already logged into macOS, then just sign out of the AppleID so you can agree to the Terms. Once accepted, you should be able to sign back into the AppleID.

Click the back button until you can Skip that particular setup, then continue on.
After you have finished setting up the OS and can login, you can return to set up that segment by going into System Preferences.
I have a black screen and the setup. If I hit go back, it just takes me to the beginning of the process again and won't let me proceed without my apple id. I've tried this several times now, each time I get to terms and conditions I can't agree, even if I scroll thru to the bottom. Stuck. Is there anyway to just get around this setup system?
This worked! Thanks!
