Start here first to get your new Apple ID set up: How to create a new Apple ID. You can then Turn on and set up iPad with your new Apple ID and any data that you may have saved in a previous back up.

If you have acquired this iPad recently, and if you are now encountering Activation Lock, then you will need to discuss this with the seller; requesting they either remove that lock, or a refund.
If this is Activation Lock you are encountering, creating a new Apple ID will not clear his.
The only recourse available is via the person holding the Apple ID associated with that Activation Lock. We can’t help clear Activation Lock, and—absent proof of ownership usually not included in used-device purchases—Apple won’t. Without that Apple ID, this iPad is indistinguishable from a lost or stolen iPad, if not actually lost or stolen. Unfortunately, fraudulent online sales are common, too.
