If I do not find a My Photo Stream album in my Photos app, am I in the clear?

That indicates that you are not using Photo Stream. If you want to double check, go to Settings>Photos. Do you see the option to use My Photo Stream? If not, you are good. If you see the option but it is not enabled, you also good.
