You have run into the Activation Lock. A security feature.

You will need that previous owner’s credentials to remove the Activation Lock. You are not going to be able to use that iPhone without it. Contact the seller and get those credentials or ask for your money back. If you cannot get a hold of the seller, then it was likely a stolen iPhone.

The next time you purchase an Appledevice, then make sure that you can log into it. For an iPad, have the original user use this site: What to do before you sell, give away, or trade in your iPhone, iPad, or iPod touch - Apple Support. They should have known better.

Login Prior to Buying:

Request that you are able to log into it, and assign it to your account, prior to handing over the money. If the seller decides to disabide by those rules you've set fourth, then do not proceed with the transaction.
