leave a family after divorce and take children accounts

My husband created the Apple share family account. He added me (the wife) and all our children's accounts to it when he created it, and that is how I have been managing their data usage.

In the event that I am awarded custody in the divorce, how can I separate my ID from the family account that he controls and take the children's accounts with me? I need to be able to do this in the event that he is uncooperative.

Thanks,

You do need the organizer to approve the move.

The kids have Apple ID’s, so anything associated with their ID’s should move over with them to the new family.

Move a child to another group using Family Sharing - Apple Support

EDIT - I edited the original post to correct the information.

To move a child to another family group, you or another guardian needs to invite them. After you send the invitation, the child's current family organizer must approve the request on their iPhone, iPad, iPod touch, or Mac. Then the child will move from their current family group to the other family group.
